InstantGPU Refund & Cancellation Policy

1. Scope and Overview

This Refund & Cancellation Policy ("Policy") applies to all purchases, prepaid credits, usage-based charges, subscriptions and other fees paid for InstantGPU services operated by Qmoniqs Software Private Limited ("InstantGPU", "we", "us", "our"). InstantGPU provides usage-based GPU computing, serverless workloads, public AI endpoints and related digital services. Because compute resources are provisioned and consumed in real time through third-party infrastructure, the general rule is that all charges are final and non-refundable once incurred.

2. General Rule – No Refunds

Unless mandatory applicable law provides otherwise, the following are non-refundable:

  • All charges for compute time, GPU usage, serverless executions, public endpoint requests, storage, data transfer and any other consumed resources once the usage has been recorded;
  • Purchased prepaid credits (whether used or unused);
  • Promotional, bonus, referral or free credits;
  • Subscription or plan fees for any period that has already commenced; and
  • Any other fees once the corresponding service or capacity has been made available.

Credits represent a right to consume eligible Services and are not a bank deposit, stored-value account or cash equivalent. Credits are non-transferable and may not be redeemed for cash except where required by mandatory law.

3. Narrow Exceptions

InstantGPU may, at its sole discretion or where required by law, provide a remedy in the following limited cases:

3.1 Failed Provisioning

If a paid resource is successfully charged but InstantGPU is unable to provision any usable capacity and no service is delivered to the Customer, InstantGPU will, after verification, restore the applicable credits or provide an equivalent remedy. This does not apply where capacity was provisioned and later became unavailable due to third-party provider issues, Customer configuration, network conditions outside InstantGPU’s control, or any exclusion listed in the Service Level Agreement.

3.2 Billing or Technical Errors

Duplicate charges, clear system errors resulting in incorrect billing, or charges for failed requests that InstantGPU’s systems confirm were never executed may be credited after investigation.

3.3 Mandatory Legal Rights

Nothing in this Policy excludes or limits any non-waivable consumer, statutory or other mandatory rights under applicable law (including, where applicable, certain withdrawal rights under consumer-protection legislation). Where such rights apply and cannot be waived, InstantGPU will honour them.

4. Third-Party Provider Outages

InstantGPU sources capacity from third-party infrastructure providers. Outages, performance degradation or unavailability caused by those providers are addressed solely under the Service Level Agreement (if any) applicable to the Customer’s service tier. No cash refund is available for provider outages. Service credits, if any, are the sole remedy and only to the extent InstantGPU receives equivalent credits from the underlying provider or under the published SLA credit schedule.

5. Subscription and Plan Cancellation

You may cancel a subscription or recurring plan at any time through the dashboard or by written notice to [email protected] where the dashboard does not support cancellation. Cancellation prevents future automatic renewal but does not entitle you to a refund of fees already paid or for the current billing period. Access continues until the end of the paid period unless InstantGPU terminates earlier for cause.

6. Chargebacks and Payment Disputes

Before initiating a chargeback or payment dispute with your bank or card issuer, you must contact InstantGPU support at [email protected] and allow a reasonable opportunity to resolve the issue. InstantGPU may suspend or terminate accounts that initiate chargebacks without a valid basis or without prior contact, subject to applicable law. Fraudulent or abusive chargebacks may result in permanent account closure and recovery of costs.

7. Taxes

Any refund or credit of taxes will be handled in accordance with applicable tax rules and the original transaction. Customers remain responsible for any taxes that InstantGPU is required to collect or that the Customer is legally obliged to self-assess.

8. How to Request a Remedy

To request consideration under the narrow exceptions above, email [email protected] with:

  • Account email / Customer ID;
  • Transaction ID or invoice number;
  • Date and approximate time of the charge;
  • Affected service / resource; and
  • A clear description of the issue and supporting evidence.

Requests should be submitted within 14 days of the relevant charge. InstantGPU will investigate and respond within a reasonable time.

9. Relationship to Other Documents

This Policy forms part of the InstantGPU Terms of Service and is incorporated by reference. In the event of conflict, the order of precedence in the Terms of Service applies. Service credits under the SLA are governed by the SLA and are not cash refunds.

CONSUMER AND MANDATORY RIGHTS

For business customers, prepaid credits are non-refundable unless expressly stated otherwise in an applicable order, promotional offer or SLA. For consumers, any mandatory statutory cancellation, withdrawal, refund or other non-waivable rights applicable in the Customer’s jurisdiction will apply notwithstanding this Policy.

UNDERLYING PROVIDER COMPENSATION

Customer remedies under this Policy and the applicable SLA are determined by the Customer agreement and are not contingent on whether InstantGPU receives compensation from an underlying infrastructure provider.
